My name is Jason Robert Carmean. I had purchased a ‘Magix Music Maker’ Deluxe Edition about four years back and believed I was licensed under service terms agreements permitting me to use the Music Maker’s two sample C.D.’s and encorporate them into my work with music I had since been working on since mid last year with Digidesign’s Pro Tools Platform. I too now have a Native Instruments ‘Komplete 5’ platform.

I have Schizophrenia and I needed to use my mind in being creative with it to guide my mind out of the illness to this day along with applicable medicines and may have misunderstood the license agreement. I no longer have the license agreement to go over with my collegues and I. But stated on both sample C.D.’s it said ‘Usage allowed only under acknowledgement conditions.’ Although they both say too that there is no commercial lending as also mentioning that all right are reserved.

I had written a letter to Magix about two years ago mentioning my agreement with the license conditions as I had also mentioned my diagnosis being Schizophrenia. I stated that I am licensed under M-Audio, Digidesign, Magix with an exeption that I too am now license under Northstar Productions.

I don’t know if Magix had sent me written permission to use these samples… sometimes I do not recieve all of my E-mail and I am currently having difficulty with communicaton with SNOCAP where by they had said to me in an E-mail that when I sign in onto my dashboard on SNOCAP it isn’t being displayed properly.

I too am working on being distributed through Pump Audio now as well but before I get to this I had already spent over a year now creating music and not only by the use of samples and loops while too disecting these for new sounds but with the use of creating my own with my M-Audio Axiom 25 Keyboard. I am also using a Demo C.D. provided by M-Audio when I recieved my M-Audio Mobile usb amplifier and I need requested written permission to use these samples besides the license agreements I have but should go over again.

At the time where about half of my work I had composed together I began to work with Amazon’s CreateSpace and sell and distribute that is until I reread the license agreement statement on the Magix sample C.D.’s which resulted in me having to terminate the accounts with CreateSpace and Amazon. The account is officially terminated although my music is still up on Amazon’s site for sale and distribution. I don’t believe this is legal by any means now. However I have been told that information processed onto Amazon may take up to fifteen days.

I am sending this letter to the following companies in request for written permission that can be faxed to this number 13304547983 for the use of samples on the M-Audio Demo C.D. it being M-Audio, Permission to use Digidesign’s Pro Tools M-Powered 7.3 and 7.4 platforms and Northstar Productions for the use and incorporation of Native Instruments ‘Komplet 5’ Package with Pro Tools M-Powered 7.3 and 7.4.

In the matter of Magix, all songs created with the two C.D. samplers will not be used for commercial use, sales or redistributed by any means.
